La inteligencia artificial transforma el derecho. No es solo un modo de facilitar la actividad jurídica. Tiene implicaciones epistemológicas y sociales. El derecho se reduce a datos y a cálculos. Prospera un jurista maquinal. Se empobrece la racionalidad jurídica. Se olvida que la clave del derecho no es el procesamiento de datos sino la creación de sentido.

El antes y un después del comienzo de la guerra de Ucrania muestra los cambios en la opinión de los ciudadanos ante la seguridad y la defensa. No es igual en todos los países de la UE. Habrá que ver si la percepción del riesgo y la forma de hacerle frente se mantiene conforme se alarga la guerra y las consecuencias colaterales. En los gobiernos de la UE existe una cacofonía estratégica semejante a la de los ciudadanos cuando aceptan de (...) manera desigual los costes para garantizar la seguridad colectiva. Una percepción y respuesta desigual como desigual es la realidad de la UE. Las _europas _de la UE dificultan que se realice de manera cómoda los esfuerzos creadores equiparables a los peligros que la amenazan. Esfuerzos tanto en el poder blando, como en el duro. Los líderes estratégicos en la UE al margen de la retórica deben reconocer las amenazas, tomar decisiones políticas y llevar a cabo el esfuerzo continuado para reducirlas. Los ciudadanos del común aportan en número suficiente y por ahora el apoyo en ese sentido. Que en la UE no se desaproveche tanto esfuerzo del pueblo de Ucrania. (shrink)

Background The birth plan is a tool that allows the self-learning and thoughtful analysis of the women during the birthing process, facilitating their making of decisions and participation, in agreement with the bioethical principles of autonomy and no malfeasance. Goal: To understand the perception and satisfaction of women who presented a birth plan. Methodology: Qualitative, descriptive, observational, retrospective and cross-sectional study. The population of the study was composed of 21 women who presented a birth plan regulated in a Hospital ever (...) since the recording of the presentation of the birth plan was started until 2015. Place: Cartagena. Techniques/methods: Semistructured interview. Results-Discussion: Most women considered the plan as a useful self-learning tool on the meaning of the birthing process, as it favored the communication between the expectant mothers/health professionals. Our informants sought information related to the birthing process from informal sources; most perceived a level of respect of their wishes during the process of giving birth. The use of the birth plan did not imply the perception of loss of the degree of control during the birth, although attention to the written document could be improved. Conclusions The use of the birth plan is a very satisfactory and useful experience for their involvement in their self-care, although in some cases, the births did not proceed according to their plans. Nevertheless, the prevalence of the principle of Non-Malfeasance over Autonomy was evidenced. (shrink)

Por tanto, se subraya que no solo es trascendental para la eficacia de una narración la estructura y los ingredientes de ésta, sino también la manera en que se cuenta, el medio utilizado y la plataforma de visualización. In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. The present study aims to verify the psychometric properties of the Spanish versions of the Social Roles Questionnaire (SRQ; Baber & Tucker, 2006), Modern Sexism scale (MS) and Old-fashioned Sexism scale (OFS; Swim et al. Swim & Cohen, 1997). Enough support was found to maintain the original factor structure of all instruments in their Spanish version. Differences between men and women in the scores are commented on, mainly because certain sexist attitudes have been overcome with greater success in the current (...) Spanish society, while other issues, such as distribution of power in organizational hierarchies or distribution of tasks in the household, where traditional unequal positions are still maintained. In all cases, it was found that men showed greater support for sexist attitudes. The correlations between the three instruments were as expected in assessing sexist attitudes that tend to relate to each other. Eventually, we found no empirical evidence for the postulated link between sexist attitudes and traditional gender stereotypes. Our results call for the validity and effectiveness of the classic theories of gender psychology, such as gender schema theories (Well, 1981; Markus et al., 1982) and the notion of a gender belief system (Deaux & Kite, 1987; 2001). The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem. The relationship between John the Baptist and Jesus of Nazareth is defined by most New Testament scholars and historians of Christianity in terms such as “contrast”, “radical difference” or “parting of the ways”. This article aims at reviewing in a detailed way the many phenomenological parallels that the sources permit to establish between these Palestinian preachers of the first half of the 1st century c.e. (a task which has virtually not been made before). i will also reconsider some supposed differences (...) which, according to most scholars, imply the existence of a contrast between them, and i will argue that these differences do not exist or are not important enough to build a contrastive image. in this way, i aim at showing that the idea of a sharp opposition between John and Jesus is an untenable view and the result of a distortion of the available data due to ideological (more specifically, theological) prejudices. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, (...) la extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

In consciousness studies there is a growing tendency to consider experience as (i) fundamentally affective and (ii) deeply interlinked with interoceptive and homeostatic bodily processes. However, this view still needs further development to be part of any rigorous theory of consciousness. To advance in this direction, we ask: (1) is there any affective type that is always present in consciousness?, (2) is it related to interoception and homeostasis?, and (3) what are its properties? Here we analyse and compare Jim Russell's (...) core affect and Thomas Fuchs' concept of vitality, and propose a more encompassing notion that subsumes both: continuous organismic sentience. It provides affirmative answers to questions 1 and 2, and, regarding question 3, a preliminary list of thirteen properties divided into ontological, phenomenological, and functional categories. This is the first of a series of studies that will systematically address different notions of a fundamental, homeostatically-rooted affective type, to achieve a rigorous, unified concept for consciousness science. This article analyzes the relationship between corporate social responsibility (CSR) decoupling and financial market outcomes. CSR decoupling refers to the gap between CSR disclosure and CSR performance. More specifically, we analyze the effect of CSR decoupling on analysts’ forecast errors, cost of capital, and access to finance. We also examine the moderating effect of forecast errors on relationships between CSR decoupling and cost of capital and access to finance. For a sample of U.S. firms consisting of 7,681 firm-year observations for (...) the period 2006–2015, our empirical evidence supports the idea that a wider gap results in higher analysts’ forecast errors, a greater cost of capital, and reduced access to finance. In addition, our results show that forecast errors enhance the effect of the CSR decoupling on cost of capital and access to financial resources. We also note that external monitoring, in the form of greater analysts’ coverage, reduces CSR decoupling. (shrink)

We highlight how Corporate Social Responsibility can be strategically used against the negative perception from earnings management. Using international data, we analyse the effect of CSR and EM on the cost of capital and corporate reputation. Results confirm that CSR strategy is positively valued by investors and other stakeholders. Contrary to EM, CSR has a positive effect on corporate reputation and lowers the cost of capital. In addition, we also find that the favourable effect of CSR on cost of capital (...) is consistently more intense in firms that show signs of EM indicating that the market does not identify when CSR practices are used as a strategy to mask EM. We also demonstrate how institutional factors influence the above relationship. (shrink)

Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

This paper inquires the systematical consequences in the Nietzschean critics of the biological determination of life. We proposed an analysis about central topics of this determination: the finalism, the life and chaos. This approach allows us to relieve a systematical conception of what Nietzsche understands by “necessity”. This conception of necessity is not metaphysic in the traditional sense, but implies a subversion of all special metaphysic. Beyond this, it entails a critical to the transcendental and normative version, own of Kantian (...) thought, about the question of life. These confrontations seek to clarify the gnoseological and ontological areas put in check, on the status of the concept of life. (shrink)

Resumen El presente artículo ofrece una interpretación teleológica de la vida consciente y se basa, sobre todo, en la postura fenomenológica de Emmanuel Levinas. Sin embargo, es preciso tener en mente que la fenomenología husserliana está siempre presente como sustrato de ésta. Por ello, a partir de una lectura en que ambas perspectivas se complementan, trazaré un esquema en el que la totalidad de la conciencia se realiza como teleológica y explicaré el papel preponderante que cumple la síntesis en los (...) procesos de constitución para desarrollar los elementos de la ética levinasiana que culminan en una lectura teleológica de la vida consciente. Así, la infinitud con la que Levinas describe el encuentro ético deja de ser sólo una instancia de corte ético-ontológico para describir un momento teleológico.The present paper proposes a teleological interpretation of conscious life based on the phenomenology of Emmanuel Levinas. However, since Husserlian phenomenology serves always as a background for Levinas’s position, I offer a reading in which both views complement each other. First I lay out a scheme in which the totality of consciousness is realized as teleological and then I explain the predominant role played by synthesis in the constitution processes in order to develop the elements of a levinasian ethics culminating in a teleological reading of conscious life. Thus, the infinity with which Levinas describes the ethical encounter ceases to be only an instance of an ethical-ontological dimension to describe a teleological moment as well. (shrink)

A través de un estudio en profundidad de la bibliografía, casos piloto y proyectos similares, se ha creado un sistema de indicadores con la finalidad de medir el impacto socioeconómico de una actividad sociodeportiva vinculada a la inclusión de personas con diversidad funcional. Este artículo aborda desde una perspectiva crítica la relación entre las categorías de democracia y ciudadanía en la ciudad de Valparaíso durante la última década de postdictadura. El principal supuesto del texto considera la imposibilidad de un análisis conceptual acerca de la democracia que no incluya en su discusión la tensión entre la posición y ejercicio de la ciudadanía implicada y demandante en este proceso. El análisis propuesto confronta los imaginarios hegemónicos instituidos en la postdictadura con los imaginarios instituyentes que (...) emergen de los movimientos secundarios por la defensa de la educación pública en la ciudad de Valparaíso. Estos imaginarios se expresan en formas de organización en la esfera pública, por medio de la función que ejerce el imaginario radical, que impugnan la construcción de una ciudadanía capturada y una democracia tutelada. This article focuses on the relationship between the categories of democracy and citizenship in Valparaíso during the last post-dictatorship decade from a critical perspective. The main assumption of the text relates to the impossibility of conceptual analysis on democracy without including in its discussion the tension between the position and the exercise of the demanding, involved citizenship in this process. The proposed analysis brings face to face the hegemonic imaginaries established during the post-dictatorship period and the establishing imaginaries that arise from the secondary school movements for defending public education in Valparaiso. These imaginaries are expressed in forms of organization within the public circle, through the role that plays the radical imaginary, which challenge the construction of a captured citizenship and a democracy under custody. This paper studies two of the best-known actresses, Nell Gwyn and Anne Bracegirdle, and the different public personae they created to negotiate their presence in this all-male world. In spite of their differing strategies, both women gained fame and profit in the male-dominated (...) theatrical marketplace, confirming them as the ultimate “gender benders,” who appropriated the male role of family’s supporter and bread-winner. A rigorous cladistic analysis of the dorsal pallium of amniotes indicates that the stem amniote lacked sensorimotor areas. Reptiles apparently acquired a visual cortex by parcellation from the multimodal, hippocampal-like mediodorsal pallium of stem amniotes. The high number of sensory areas of the mammalian isocortex might derive from the specific properties it shows, such as growth-promoting influence on thalamic axons.
